周董遞狀反擊 保５千萬存款

周杰倫與老東家阿爾發的合約糾紛愈演愈烈。在阿爾發向法院聲請假扣押周杰倫的5000萬元存款後，周杰倫昨天下午委任律師向台北地方法院遞狀反擊，要求阿爾發「限期起訴」本案，釐清雙方的著作權糾紛。
台北地院將在2天內做出裁定，要阿爾發在5到7天內決定是否要起訴控告周杰倫違約。如果阿爾發在期限內未提起訴訟，先前的假扣押就失效。

周董在阿爾發八年來作了七張專輯，今年3月1日雙方合約期滿，周董自立門戶，成立杰威爾公司。周杰倫認為，七張專輯的「錄音」及「視聽」著作權歸他所有，阿爾發不同意，雙方發生著作權糾紛。

上月初，阿爾發向法院聲請假扣押，查扣周杰倫的財產2億元獲准，由於阿爾發必須向法院繳交1/3約6600多萬元的擔保金，但在一個月法定期限內，阿爾發未繳交擔保金，這項假扣押裁定隨即失效。

阿爾發後來縮減金額，重新向法院聲請假扣押周杰倫的銀行存款5000萬元，這次阿爾發如期繳交1/3的擔保金，法院於是查扣了周杰倫的銀行存款5000萬元。

周杰倫不滿阿爾發的作法，昨天委任律師向台北地院遞狀，要求阿爾發限期起訴。也就是說，阿爾發查扣周杰倫的存款後，必須在法院裁定的期限內提起「本案訴訟」，讓全案進入司法程序，由法官來裁奪雙方著作權的歸屬。

據了解，阿爾發原是吳宗憲成立的，因此這場著作權糾紛，吳宗憲勢必會被法院傳訊作證。

Because I have been ignoring Jay for long enough and am curious at what has he been doing recently, and want to find out the reason on why his popularity suddenly decreased ( I thought Jay's Still Fantasy did well what, and that was only a few months ago, must be something that happened.)

So I came across this, hm.. I didn't know he n his ex-company is having a law suit which each other. And that company is DAMN JIAN!!
*if you have read the news you will know why*

Since the contract expires on March, Mr Jay don't want to continue is his own right, how the hell is that equating to breaching a contract?

And plus, every single song is written and sung by Jay, ALFA should be the one paying the copyright.

Most importantly, it is all stated in the contract.
周杰倫剛出道時，簽給吳宗憲，合約也是吳宗憲擬的，昨天吳宗憲表示：「當初合約上寫得很清楚，杰倫的著作權由阿爾發代理，既然合約結束，代理也就結束，不管合約後來轉到誰的手上，合約擺明了就是著作權是杰倫的。」他主張把著作權還給周杰倫，還說：「合約是我擬的，我很清楚，對方現在企圖把著作權留一輩子，這樣不對嘛！」

Jay will definitely win, but stupid ALFA is making jay suffer the costs of unnecessary lawsuit. F*** THEM.

This scenario reminds me of the risk-shifting problem, when a company is in financial distress ( i think alfa will go bankrupt after Jay leaves) shareholders like to take on negative NPV projects ( law suit).

And finally, I have to say.
WHAT THE HECK? ALFA ACTUALLY REQUESTED TO FREEZE JAY'S ACCOUNT.
I WOULD SO LIKE TO BURN DOWN THE WHOLE OF ALFA NOW.

his new movie is going to be released! I will be back in singapore to watch it..
